Pursuant to applicable personal data protection laws, InduSmart Digital Partners, SL informs you that the personal data collected through the forms on the website www.indusmart.digital is stored in the specific automated files of users of InduSmart Digital Partners, SL's services.

Personal data is collected and processed automatically for the purpose of maintaining the business relationship and carrying out information, training, advisory, and other activities of InduSmart Digital Partners, SL.

The user represents that all data they provide is true and accurate, and agrees to keep it up to date by notifying InduSmart Digital Partners, SL of any changes.

For what purpose will we process your personal data?

InduSmart Digital Partners, SL will process the personal data collected through the website www.indusmart.digital for the following purposes:

1. To provide its services in accordance with the specific needs of its clients, in order to perform the contracts it has entered into.
2. Please note that you may object to receiving commercial communications by any means and at any time by sending an email to the address indicated above.
3. The fields in these records are mandatory; the stated purposes cannot be fulfilled if this data is not provided.

How long is the personal data collected retained?

The personal data provided will be retained for as long as the business relationship continues or until you request its erasure, and for the period during which legal liability may arise from the services provided.

Intellectual property rights of www.indusmart.digital

InduSmart Digital Partners, SL owns all copyrights, intellectual and industrial property rights, know-how, and any other rights relating to the content of the website www.indusmart.digital and the services offered on it, as well as to the programs required to implement it and the related information.

Reproduction, publication, and/or any use other than strictly private use of the content of the website www.indusmart.digital, in whole or in part, is prohibited without prior written consent.

Intellectual property of the software

The user must respect any third-party programs that InduSmart Digital Partners, SL makes available to them, even if those programs are free of charge and/or publicly available.

InduSmart Digital Partners, SL holds the necessary exploitation and intellectual property rights to the software.

By contracting the service, the user does not acquire any right or license to the software required to provide the service, or to the technical information used to monitor the service, except for the rights and licenses necessary to perform the contracted services, and only for the duration of those services.

For any action beyond the performance of the contract, the user must obtain written authorization from InduSmart Digital Partners, SL. The user is prohibited from accessing, modifying, or viewing the configuration, structure, and files of the servers owned by InduSmart Digital Partners, SL, and assumes civil and criminal liability for any incident that may occur on the servers and security systems as a direct result of negligent or malicious action on their part.

Intellectual property of hosted content

Any use of the services provided by InduSmart Digital Partners, SL that violates intellectual property law is prohibited, in particular:

1. Any use that violates Spanish law or infringes the rights of third parties.
2. Publishing or transmitting any content that InduSmart Digital Partners, SL considers violent, obscene, abusive, illegal, racist, xenophobic, or defamatory.
3. Cracks, software serial numbers, or any other content that infringes the intellectual property rights of third parties.
4. Collecting and/or using other users' personal data without their express consent or in violation of Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016, on the protection of natural persons with regard to the processing of personal data and on the free movement of such data.
5. Using the domain's mail server and email addresses to send unsolicited bulk email.

The user bears full responsibility for the content of their website, the information transmitted and stored, hypertext links, third-party claims, and legal actions relating to intellectual property, third-party rights, and the protection of minors.

The user is responsible for complying with the laws and regulations in force and with the rules governing the operation of online services, electronic commerce, copyright, and the maintenance of public order, as well as the universal principles of internet use.

The user shall indemnify InduSmart Digital Partners, SL for any costs incurred if InduSmart Digital Partners, SL is named in any proceeding for which the user is responsible, including attorneys' fees and legal defense costs, even if the court decision is not final.

Protection of hosted information

InduSmart Digital Partners, SL makes backup copies of the content hosted on its servers; however, it is not responsible for the loss or accidental deletion of data by users. Likewise, it does not guarantee the full restoration of data deleted by users, since that data may have been deleted and/or modified in the time elapsed since the last backup.

Except for specific backup services, the services offered do not include restoring content stored in the backup copies made by InduSmart Digital Partners, SL when the loss is attributable to the user; in that case, a fee will be set based on the complexity and volume of the recovery, always subject to the user's prior acceptance.

Restoration of deleted data is included in the price of the service only when the loss of content is due to causes attributable to InduSmart Digital Partners, SL.

Commercial communications

Pursuant to the Spanish Information Society Services Act (LSSI), InduSmart Digital Partners, SL will not send advertising or promotional communications by email or any equivalent means of electronic communication unless the recipients have previously requested or expressly authorized them.

For users with whom there is a prior contractual relationship, InduSmart Digital Partners, SL is authorized to send commercial communications about InduSmart Digital Partners, SL products or services that are similar to those the client originally contracted.

In any case, after verifying their identity, the user may request through the Customer Service channels that no further commercial information be sent to them.
